Terms & Conditions
These Terms govern your use of the That Socials Team website and the purchase of services from That Socials Team. By using our website or engaging our services, you agree to be bound by these Terms. They are governed by the laws of Queensland, Australia and the Australian Consumer Law (ACL).
1. About these Terms
These Terms and Conditions ('Terms') govern your use of the That Socials Team website at thatsocialsteam.com.au and the purchase of services from That Socials Team ('we', 'us', 'TST'). If you do not agree to these Terms, please do not use our website or engage our services.
2. Our services
That Socials Team is a content creation business. We plan, film, and edit short-form video content for business owners. We do not provide social media management, account management, posting, scheduling, or strategy services unless separately agreed in writing.
Current offerings include our content creation packages (Filmed & Featured, The Curated Edit, Presence Pass, and Raw Content Only), the Presence Map strategy product, Show Up Club membership, and event coverage packages. Service descriptions on our website are subject to change. Scope is confirmed in writing prior to commencement.
3. Booking and payment
A booking is confirmed once we have received payment in full (or a deposit where specified) via our Stripe payment link or another method agreed in writing. Invoices are issued via Xero and are payable within 24 hours of issue unless otherwise stated. We reserve the right to cancel an unconfirmed booking if payment is not received within this period.
All prices are listed in Australian Dollars (AUD) and, unless stated otherwise, are inclusive of GST where applicable. Show Up Club membership pricing may be displayed in USD as required by the platform hosting it. Travel fees may apply for services delivered outside the Gold Coast and Moreton Bay regions of South East Queensland; travel costs will be discussed and agreed prior to booking.
4. Cancellations and rescheduling
- More than 5 business days before the shoot: full refund, less any non-recoverable third-party costs already incurred.
- Within 5 business days of the shoot: we reserve the right to retain a cancellation fee of up to 50% of the total booking value.
- Within 24 hours of the shoot, or failure to attend: no refund will be provided.
- Rescheduling requests more than 5 business days in advance will be accommodated where possible at no additional charge.
We reserve the right to cancel or reschedule a shoot due to circumstances beyond our control (including weather, illness, or equipment failure). In such cases we will work with you to find a suitable alternative date. No cancellation fee will apply if we initiate the cancellation.
5. Intellectual property and content ownership
Ownership of all content produced by TST (including raw footage, edited videos, photographs, and associated files) remains with TST until payment in full has been received for the relevant service. Upon receipt of payment in full, TST grants you a non-exclusive, perpetual, royalty-free licence to use the delivered content for your business purposes, including on your website and social media channels.
TST retains the right at all times to use any content created for you for our own portfolio, website, social media, and marketing purposes. If you do not wish TST to use specific content this way, you must notify us in writing prior to the shoot. You warrant that you have all necessary rights and permissions in respect of any material, branding, music, or intellectual property you provide or request us to incorporate, and you indemnify TST against any claims arising from your failure to obtain such rights.
6. Client responsibilities
- Provide accurate and complete information during booking and briefing.
- Be available and present at the agreed shoot location at the agreed time.
- Ensure the shoot location is appropriately prepared and accessible.
- Obtain any necessary permissions for filming at third-party locations.
- Ensure individuals appearing in the content have consented to being filmed and to the content being used as described in these Terms.
We are not responsible for delays or reduced output resulting from your failure to meet these responsibilities. Additional costs incurred may be charged to you.
7. Deliverables and turnaround
Deliverable quantities and turnaround timeframes are as specified in your service package. Turnaround times are calculated in business days from the date we receive all necessary materials. Rush turnaround requests (where available) attract an additional fee of $150 and are subject to availability.
We deliver content via Google Drive or such other method as agreed. You are responsible for downloading and backing up your content. We retain working files for 90 days after delivery, after which they may be permanently deleted.
Revision requests are included and available for one week (7 calendar days) from the date your content is delivered. Revisions include minor adjustments such as colour correction, text changes, caption edits, and pacing adjustments. Requests received after the one-week window, or requests requiring re-filming or a significant creative overhaul, are out of scope and will be quoted separately.
8. Limitation of liability
To the extent permitted by law (including the ACL), TST's total liability to you in connection with any service is limited to the amount you paid for that service. We are not liable for any indirect, consequential, incidental, or special loss or damage, including loss of revenue, opportunity, or reputation. Nothing in these Terms excludes, restricts, or modifies any right or remedy implied or imposed by the ACL that cannot be lawfully excluded.
9. Australian Consumer Law guarantees
Our services come with guarantees that cannot be excluded under the ACL. You are entitled to a refund or replacement for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
10. Use of website
You agree to use our website only for lawful purposes. You must not introduce viruses, malicious code, or other harmful material to our website. Content on our website, including all text, graphics, logos, and images, is the property of TST or our licensors and is protected by Australian copyright law.
11. Enquiry forms and communications
When you submit an enquiry via our website, you consent to us contacting you in response. Submitting an enquiry does not create a binding contract or guarantee availability.
12. Changes to these Terms
We may update these Terms from time to time. Updated Terms will be published on our website with a revised effective date. Continued use of our website or services after changes are published constitutes acceptance. For confirmed bookings, the Terms in place at the time of booking will apply, unless otherwise agreed in writing.
13. Disputes
If a dispute arises, you agree to contact us first to try to resolve it informally. If we cannot resolve the dispute within 30 days, either party may refer the matter to the Queensland Civil and Administrative Tribunal (QCAT) or another appropriate dispute resolution body.
14. Governing law
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
